LLCs, & Business Succession Planning

Prenuptial Agreement
Premarital planning helps couples prepare for the financial side of marriage. A prenuptial agreement encourages transparency about assets and debts and sets expectations for how property will be managed during the marriage or divided if the marriage ends. If a couple marries before signing a prenup, a postnuptial agreement may be an option.
Special Needs Stand Alone Trust
A special needs trust (or subtrust) allows assets to benefit someone receiving SSI or Medicaid without affecting eligibility. Including one in an estate plan can preserve benefits while enhancing the beneficiary’s quality of life.
Credit Shelter Trust
A Credit Shelter Trust can help married couples with taxable estates pass more wealth to their heirs by maximizing estate tax exemptions. Although these trusts are less common now that the federal estate tax exemption is up to $15 million, they may still be worth considering for estates near the limit, especially if assets may appreciate significantly.
Deeds
We offer deed search and recording services to support the formation of trusts and LLCs. We also prepare transfer-on-death deeds, which can help real property pass outside of probate at the grantor’s death.
Advance Health Care Directives
An Advanced Healthcare Directive has two main parts: one states the grantor’s wishes for end-of-life care, and the other names an agent to make medical decisions if the grantor cannot speak for themselves. We provide an AHCD in both the Will Package and the Trust Package.
Power of Attorney
A durable general power of attorney lets an appointed agent handle the grantor’s finances during incapacity. During drafting, the grantor can choose which powers to include. We provide a POA in both the Will Package and the Trust Package.
Disposition of Remains Document
A Disposition of Remains document appoints an agent to make funeral and burial decisions. In Virginia, the decision is automatically given to the next of kin if no DOR is made. This document can also state whether the grantor wishes to be buried or cremated. We provide a DOR document in both the Will Package and the Trust Package.
Life Insurance/Irrevocable Trust
Irrevocable trusts offer benefits that revocable trusts do not, including potential tax advantages and asset protection. Because they generally cannot be easily changed or dissolved, they may be useful for high-net-worth estate tax planning, Medicaid planning, long-term care planning, or holding life insurance policies.
