We offer deed search and recording services to support the funding of trusts and formation of LLCs. We also prepare transfer-on-death deeds, which can help real property pass outside of probate at the grantor’s death.

Important Notes About Insurance

Recording a new deed can have an impact on homeowners insurance. If you’ve recently recorded a new a deed you should notify your homeowner’s insurance provider to update the policy to reflect your trust as the titled owner. Some insurance companies will request a copy of the recorded deed or the trust certificate for their records.

Important Notes About Mortgages

Transferring properties with mortgages requires a few additional considerations. Under the Garn-St. Germain Depository Act, most transfers made during estate planning will not trigger any due-on-sale clauses, however there are some notable exceptions.

For example, transferring mortgaged property to an LLC can act as a trigger for the due-on-sale clause.
